4 Differences between Visas and Stay Permits You Should Know

Every time you visit a foreign country, you are definitely required to have a visa that is used as a permit to enter that country.

Known as a visa on arrival, namely a visa obtained on arrival to enter the country for a limited time.

However, these visas can usually only be used for a limited time, usually days or weeks. In accordance with its purpose which is usually used for holidays or short visits.

Then, what if you want to stay for a longer duration abroad? Of course you have to take care of a different permit, not a visa on arrival. For foreign nationals who wish to stay in Indonesia for a long duration, they must prepare a Limited Stay Permit Card or known as KITAS Indonesia.

Kitas is a document that is used as a permit to stay in Indonesian territory for foreign nationals with a period of one year and must be renewed every year.

KITAS is required if you want to work or stay in Indonesian territory for a longer time as a foreigner.

The basis for granting KITAS is foreign workers who come to Indonesia for work, retirement and other purposes.

After obtaining a KITAS, expatriates and foreign nationals can stay in Indonesia legally. If a foreign national stays longer than the visa visit period, the foreign national will be subject to a maximum imprisonment of 5 years and a maximum fine of $37,000.

Before knowing more about KITAS, there are types of KITAS that you should know about. Here is the information:

I. Types of KITAS

  • a. Work Permit KITAS

Indonesian KITAS work visa must be sponsored by a company or organization registered in Indonesia. Among them are, PT, PT PMA, Representative Offices, and public or private institutions.

Before obtaining a KITAS work visa, you will be asked to obtain a work permit/permit to employ foreign workers) by confirming your position and work location at a sponsoring company in Indonesia.

Your job position also determines the duration of your KITAS. Sponsorship is required before a work visa or work permit can be processed. The sponsoring company must submit the applicant’s work carefully based on the regulations set by the Ministry of Manpower.

The sponsor for a KITAS work visa is legally responsible for the visa applicant, ie paying a fine if the applicant does not have the ability to do so.

Therefore, it is important for sponsors to be aware of this responsibility.

  • b. Marriage Visa KITAS

Foreigners who are legally married to Indonesian citizens can be sponsored by their spouse to get a KITAS family visa. However, this visa is not the same as a work visa, the owner of this visa is only allowed to live, and is only allowed to work as a  freelancer.

An official marriage certificate legalized by the Indonesian government is a mandatory requirement. On the other hand, if you get married abroad, what you need is a Certificate of impediment to marriage .

Then you can apply for a permanent residence visa (KITAP) after two years of marriage. KITAP is valid for up to five years with multiple exit and re-entry permits .

  • c. Retirement Visa KITAS

This visa does not apply to business owners or entrepreneurs.

However, if you are 55 years old or older, and want to spend your retirement in Indonesia, you can enter Indonesia first with a tourist visa. Then you can apply for a KITAS retirement visa after one month.

With this visa, you can live in Indonesia for many years. You can also open a local bank account.
